How does separation actually work in Ontario?
There's no single "separation filing" — you're separated once you're living separate and apart, even under the same roof. From there, property, support, and (if applicable) parenting arrangements are worked out through negotiation, mediation, or court.
How is property divided?
Ontario uses an equalization model — each spouse's net family property is calculated as of the date of separation, and the difference is generally equalized. There are exclusions for gifts, inheritances, and certain pre-marriage assets.
Do I have to go to court?
In most cases, no. Most separations resolve through negotiation, mediation, or a four-way settlement meeting. Court is available if needed, but it's rarely the fastest or most cost-effective path.
How is support calculated?
Child support generally follows the Federal Child Support Guidelines based on income and the number of children. Spousal support depends on income, length of the relationship, and each spouse's ability to become self-sufficient. We'll walk through your actual numbers on the call.
